DMCA and Copyright Policy

Undercurrent respects intellectual property rights. We respond to notifications of alleged infringement that comply with the US Digital Millennium Copyright Act ("DMCA") and with equivalent UK and EU copyright law.

Filing a takedown notice

If you believe material on Undercurrent infringes your copyright, send a written notice to our designated agent at dmca@undercurrent.band including:

1. Your physical or electronic signature.
2. Identification of the copyrighted work you claim has been infringed.
3. The URL(s) on Undercurrent of the material you claim is infringing, specific enough that we can locate it.
4. Your contact information (name, postal address, telephone, email).
5. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.

We will review complete notices and — where the claim appears valid — remove or disable access to the material and notify the affected user.

Counter-notice

If you believe your content was removed in error, you may file a counter-notice at dmca@undercurrent.band including:

1. Your physical or electronic signature.
2. Identification of the material that was removed and the location at which it appeared before removal.
3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
4. Your name, postal address, telephone, and email.
5. A statement that you consent to the jurisdiction of the courts of England and Wales (or, if you are outside the UK, of the courts where you reside or where Undercurrent is located), and that you will accept service of process from the person who filed the original notice.

If we receive a valid counter-notice we may restore the material 10–14 business days after forwarding it to the original complainant, unless we are notified that they have filed legal action.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

Abuse of process

Filing a false or bad-faith DMCA notice may result in legal liability. Consider whether fair dealing / fair use applies before filing.
